INX Media case: Karti Chidmabaram sent to judicial custody for 12 days

Karti Chidambarams father P Chidambaram was also present in the courtroom.

Various undertrials facing prosecution under the mentioned laws were lodged in Tihar Jail where Karti Chidambaram will be lodged during his period of judicial custody, hence there was fear over his security. The counsel also sought a separate cell in case Karti was sent to judicial custody.

In a related development, the Delhi High Court gave a major relief to Karti Chidambaram, directing the Enforcement Directorate (ED), which is separately probing the allegations, not to arrest him till the next hearing of the case on March 20.

CBI then argued in opposition to the plea for separate cell on the ground of "threats", and said if at all they were threats, they would be for P Chidambaram and not for Karti.

While admitting that the apprehension raised cannot be ignored keeping in view the social status of the accused and his family, the judge said, "only keeping in view the fact of social status of the accused and his father, he cannot be treated different from other accused persons and cannot be allowed to be kept in separate prison". Karti's counsel in petition said that "How can an investigative agency deny me my security".

The Court agreed to Karti's demand for medicines and spectacle but rejected his demand to provide him with home cook food.

On Friday, the CBI moved two more applications, seeking court permission to confront Karti Chidambaram with his Chartered Accountant S. Bhaskararaman, arrested last month.

The court also rejected Karti Chidambaram's plea seeking allotment of a separate prison in Tihar Jail saying that in view of social status of the accused and his father, he can not be treated different from the other accused. "He be produced on March 24", the special judge said.

Karti was arrested in connection with the INX media case from Chennai Airport on February 28 on his arrival from the United Kingdom.

The CBI had initially alleged that Karti Chidambaram received Rs 10 lakh as bribe for the FIPB clearance. Currently, he has been sent to judicial custody till March 25 in the INX Media Foreign Investment Promotion Board (FIPB) clearance case.

The fresh evidence in the case, which triggered Karti's arrest, was based on the statement of Indrani Mukerjea, former director of INX Media (P) Ltd, who recorded it under Section 164 of Code of Criminal Procedure before a magistrate on 17 February.
